Lawyer Advertising Compliance: The 2025 Update

2025 brings significant changes to lawyer advertising regulations. Multiple state bars have updated rules specifically targeting digital marketing tactics that were previously in gray zones.

Key 2025 changes: Stricter disclosure requirements for AI-generated content in marketing, expanded solicitation blackout periods, new rules for retargeting accident victims, and specific requirements for chatbot disclaimers.

AI content disclosure: Several states now require disclosure when marketing content is AI-generated. "This article was written with AI assistance" type disclaimers are becoming mandatory.

Solicitation timing: The traditional 30-day blackout after accidents has expanded to 60-90 days in some jurisdictions, and now explicitly includes digital advertising and retargeting.

Retargeting restrictions: Following website visitors with ads is now considered "solicitation" in some states, triggering consent and disclosure requirements.

Chatbot compliance: Chatbots that answer legal questions must include clear disclaimers about no attorney-client relationship and limitations of AI advice.

Multi-state practice creates compliance nightmares. You must follow the strictest rules of every state where you advertise, regardless of where you're licensed.

Recommendation: Annual compliance audit of all marketing materials and tactics by counsel familiar with multiple jurisdictions. Prevention is infinitely cheaper than defense.
